Do you understand how trusts work? A trust is one way to provide for an underage beneficiary or someone who cannot manage their finances due to medical or other conditions. Once the beneficiary is deemed capable of managing their assets, they will receive possession of the assets held in trust. Trusts are created by settlors (an individual along with a lawyer) who decide how to transfer parts or all of the individual's assets to trustees. These trustees hold on to the assets for the beneficiaries of the trust. The rules of a trust depend on the terms on which it was built. In some areas, it is possible for beneficiaries to become trustees. For example, in some jurisdictions, the grantor can be a lifetime beneficiary and a trustee at the same time. A trust can be used to determine how a person’s money should be managed and distributed while that person is alive or after death. A trust helps an estate avoid taxes and probate. It can protect assets from creditors and dictate the terms of inheritance for beneficiaries. Trusts can be established to provide legal protection for the trustor’s assets to ensure they are distributed according to their wishes. Additionally, trusts can save time, reduce paperwork, and sometimes reduce inheritance or estate taxes. Trusts can also be used as a closed-end fund built as a public limited company.
